to the buyer a Sire: _________________________________ Reg. # _____________________ Dam: __________________________________ Reg. # _____________________ The consideration for this sale shall be the sum of $___________ plus the terms and conditions hereinafter set forth. A deposit of $_____________ will hold said dog for buyer until date of delivery when the balance of $__________ is due and payable. The Seller warrants that the above described puppy/dog is a purebred dog registrable with the ___________________and shall carry the Von Fritz Kennel name. The Seller also warrants that the above described puppy/dog is in good health at the time Buyer assumes ownership. Seller also warrants that the puppy/dog sold hereunder is progeny of animals x-rayed and certified clear of hip dysplasia. This Dog is Guaranteed as Follows:To be free of hereditary hip dysplasia.To be free of Progressive Retinal Atrophy. To be healthy and of sound temperament, free from communicable diseases at the time of sale on the condition that buyer has said dog examined by a licensed veterinarian within 72 hours of receiving the dog. Full refund or replacement (if available) will be given upon receipt of original letter from examining veterinarian and return of dog within 24 hours of examination. Buyer will incur any costs to return dogs. Should said dog fail to meet guarantees as stated above and satisfies conditions of replacement/refund (stated below), he/she will be replaced with another dog or a monetary refund of one-half the purchase price, sellers option. Once said dog has been used for breeding purposes, all guarantees are null and void. Conditions of Replacement/RefundOrthopedic Foundation for Animals (OFA) determination of hip dysplasia based on radiographs taken between the dog's second and third birthdays. This excludes dysplasia caused by accidents, falls, blows, excessive crating (over 8 hours per day), excessive overweight and failure to follow recommended diet. Seller reserves the right to request that x-rays be repeated by a veterinarian of sellers choice and resubmitted to OFA.Determination of progressive retinal atrophy by a veterinary opthalmologist member of the American College of Veterinary Opthalmologists (ACVO), provided said dog is checked once yearly and a copy of all reports submitted to seller. Seller reserves the right to request a second opinion be obtained from an ACVO diplomat of seller's choice. In the case of cataracts, the condition must be bilateral and of a type know to be inherited (ie, nutritional, tramatic, geriatric, etc. cataracts do not qualify.) Return of dog (buyer incurs shipping costs), or proof of spaying, castration, or death of animal as provided by veterinarian. In the case of a Show Puppy, buyer may not spay or neuter or put dog down without first consulting with the seller and reaching a mutual agreement in writing. Buyer AgreesBuyer agrees to maintain preventative care of puppy/dog in regards to hip dysplasia such as proper nutrition (including avoiding excessive nutrition), proper exercise, and preventing stress injuries (eg. Not allowing puppy/dog to jump from heights taller than itself at the shoulder and no forced exercising, running, until at least 18 months of age.Buyer agrees that this animal will not be used for breeding purposes until it is at least 24 months of age, x-rayed and certified clear of hip dysplasia by the OFA, of sound temperament, in good health and free of communicable diseases, hereditary faults, and/or show disqualifying faults as expressed by the official Standard for the German Shepherd. Buyer agrees that the puppy/dog will reside at the home of the Buyer, to take good and reasonable care, feed and house dog properly, keep innoculations current, to keep dog contained in kennel runs or fenced years of adequate height and security and not tie out dog or allow to run at large. If buyer decides to sell or place dog, seller will be advised immediately and will be given first opportunity to obtain dog at a price no higher than that to be offered to any other party. To keep seller informed of any change of address and phone number at all times. Failure to comply with all aspects of this contract renders all guarantees null and void and seller has the right to take dog away from buyer(s). BE IT KNOWN TO ALL PARTIES ENTERING INTO THIS CONTRACT THAT IT IS A LEGALLY BINDING DOCUMENT.In the event of any breach of this agreement that cannot be resolved to sellers satisfaction, legal action will be pursued by the sellers. Buyer(s) shall be accountable for all court costs and legal fees assumed by both parties in a suit won by the sellers.
